NAIROBI, Kenya, Oct 5 – The High Court has ordered three parties claiming ownership of the vast land in Muthaiga North near the United States International University (USIU) not to commence any development activities, pending the determination of the dispute.

Justice Samson Okongo, gave the orders so as to preserve the suit property in which USIU, Maetro Connections Health Systems and Equity Bank Chief Executive Officer James Mwangi all have in different capacities staked claim.

The court gave the order in an application by lawyer Fred Ngatia representing retired President Daniel arap Moi who stated that since three different individuals have filed suits claiming to hold title deed to the suit land, the court should halt any activities on disputed parcel of land until a determination is made.

Ngatia said that the three applications before the court seek injunction against each party claiming ownership and it would be prudent that all those saying that they hold a title deed on the same land be stopped from any development.

He said in order to fast track the case, the court should consolidate the three applications and the matter be heard by one judge.

Justice Okongo allowed the consolidation of the three files and directed that parties comply with the court’s orders to file witness statements and exchange their respective documents pertaining to the case.

The court directed that the matter be mentioned on October 26, 2016 to confirm compliance.
