Court declines to compel Registrar of Political Parties to pay ODM Sh5bn/FILE
NAIROBI, Kenya, Oct 13- The High Court on Friday declined to issue orders compelling the Registrar of Political Parties to release over Sh5 billion to Orange Democratic Movement.
High Court judge Roselyn Aburiri has instead directed ODM to serve the Registrar of Political Parties with the suit papers and return to court on October 25 when matter will be argued.
The judge has however certified the matter as urgent noting that issues raised are arguable.
In the case, ODM has accused the Registrar and the Treasury of acting unlawfully and unprocedurally by failing to consult, inform or give any reasons for not disbursing or distributing all the funds as expected.
ODM claims it has been unable to conduct its activities because of under-funding since it is entitled to receive at least 40 percent of the funds distributed to political parties from the Fund.
