Gachagua survives impeachment as Senate throws out charges

During the hearing Charles Githua Githenji, who is the acting CEC Finance and Planning told the House that the budget stalemate was caused by the decision of the County Assembly to mutilate the budget, a move that is likely to bring services to a standstill including failure to pay electricity.

He was however taken to task by the County Assembly lawyer Charles Njenga on the issue, who accused the witness of lying to the Senate.

In their presentation before Senate, the County Assembly, through lawyers Charles Njenga and George Ng’ang’a, maintained there were sufficient grounds for the county boss to be removed from office.

“The charges that are before you are grave, they are gross and they are weighty. There was non-disclosure of funds expended by the county executive. It is a legal obligation that enjoins the county executive to make a full and frank disclosure of all expenditure in the period under review. Why was it not disclosed?” posed Njenga.

In a two-hour afternoon session, the lawyers presented evidence for each of the three accusations levelled against Gachagua including abuse of office, gross violation of the Constitution and breach of law.

The Nyeri MCAs have accused Gachagua of alleged irregular procurement processes, misappropriation of funds and failure to assent to the Sh6.4 billion budget and failure to appoint enough county executives.
