NAIROBI, Kenya, Jul 21 – The Political Parties Dispute Tribunal (PPDT) has rejected an application by a section Party of National Union officials seeking the removal of their Secretary-General John Okemwa Anunda from office.

The tribunal’s chairman Kyalo Mbobu said the attempt by the disgruntled members did not follow the party Constitution.

Mbobu said that NEC members ought to have given the SG an opportunity to defend himself over the allegations they had.

He ruled that a decision by the officials to hold a National Executive Committee meeting which resolved to remove Anunda acted outside the Constitution.

“Their (PNU National Executive Committee) resolution cannot be held as some of the people who sat at the NEC were strangers,” he said.

In his judgment delivered on Thursday, the tribunal chairman declared the action unlawful, saying that Secretary General is the most powerful person in the party.

“The removal of the SG must always be within party Constitution and proper procedures must be followed,” Mbobu said as he dismissed the claims against Anunda as ‘lacking substance and evidence’.

He noted that the NEC meeting held on April 2, had not attained the two-thirds quorum required to pass a resolution for removal of the SG.

The tribunal had suspended PNU from convening its Annual National Delegate Congress meeting after party officials Mwajuma Rajab Abdalla and Irene Kopi Muronji lodged a complaint against Anunda, saying that he has no power to call such meeting.

They submitted to the tribunal, that Anunda has a disciplinary case adding his action purporting to convene the congress is illegal and goes against the Party Constitution.

“The party’s NEC was not informed of the meeting as required by the Constitution. There are rules and procedure to be followed as contained in the Party constitution,” the tribunal heard.

The Party’s Complaints and Disciplinary Committee has not cleared Anunda.
