NAIROBI, Kenya, Jul 14 – The National Land Commission (NLC) has asked the United States International University to present its ownership documents of the disputed 20 acres of land in Muthaiga North estate.

The university is locked in a dispute with a US-based businessman George Kiongera, who insists that the land was sold to him by former President Daniel arap Moi at a cost of Sh500 million.

In a bid to establish the real owner, the Commission in a letter to USIU Vice Chancellor Dr Tiyambe Zeleza, has given them seven days to present their documents.

“The Commission hereby offers to get into the matter and help resolve the dispute in line with its mandate,” reads the letter, written by NLC Chief Executive Officer Chivangi Aziz on Wednesday.

Kiongera is already in the process of preparing the land for massive investment, while the university has vowed to pursue all measures to reclaim it, after Wednesday’s protest and presentation of a petition to the police.

Capital FM News visited the prime land and established it has already been fenced off and tens of youths already hired to clear the bushes while others man the plot to keep off “intruders” after obtaining a court order.

The investor said his documents are genuine and that the university could have fallen victim to land cartels, some of whom he says are staff members.

“The blame should squarely be on the legal officer who transacted on behalf of USIU, because in the land’s office, the LR number that they have on their title is completely different from LR Number in the map that indicates the physical presence of the land,” he asserted.

“They are either confused as to the physical location of their land or they are a victim of a very cruel conman ship. We all know that in that in that particular area, the certificate of titles was direct grants from the government to the allottees.”

To him, the documents USIU is using to claim ownership are not genuine.

“Their title deed indicates 2007 and yet he say they bought the land from ICEA Insurance. They were supposed to be the second entry, which is not the case,” he said. “I am sorry it is not a title, it is a junk of paper.”

The VC on his part says that the university acquired the land in 1999 from an insurance firm. Documents seen by Capital FM News indicate that the institution acquired the title deed eight years later, in 2007.

“The land was in our possession from 1999 when we bought it; we’ve been paying the land rates to the City County Government all along,” he said.

While USIU identifies that land as LR No 12597/2, the private developer’s title deed indicates its LR No 12422/19.
