NAIROBI, Kenya, Jul 29 – The leadership of the Ethics and Anti- Corruption Commission has been restrained from issuing statements to the media calling for the resignation of the EACC Chairman Philip Kinisu.
High Court Judge Justice Mbugua Mureithi said since there is an ongoing investigation, EACC Vice Chairperson Sophia Lepuchirit, Commissioners Dr Dabar Abdi Maalim, Paul Mwaniki Gachoka, Rose Mghoi Macharia and Secretary Halakhe Waqo should keep off the matter.
The judge gave the order in an application filed by political activist Okiya Omtatah who argued that their continued statements to the media will interfere with the ongoing investigations.
Justice Mureithi directed that the petition be served upon the CEO, Vice Chair and the Commissioners and that the matter be heard inter-partes on August 9.
Omtatah told the court that the statement calling for Kinisu to step aside was interfering with the investigation by the Director of Criminal Investigations.

On Thursday, the EACC’s top brass asked Kinisu to voluntarily step aside to allow a probe into corruption allegations against Esaki Limited.
They said his continued stay will be in conflict of interest since he is linked to the company which is under investigation over the NYS scandal.

His exit, they said will also pave way for the commission to carry out independent investigations regarding to the NYS scam and involvement of Esaki Limited.
They further wrote to the Attorney General seeking for his legal advice over Kinisu’s continued stay as EACC chair whereas his name is tagged to the company under investigation.
