Nyachoti’s apparent turnaround caught the attention of Omesh Kapila, one of the tribunal members, who questioned his lack of interest in questioning Abdullahi now that he could respond.
“During that cross-examination, we were left with the impression that what was being suggested to Justice Njagi was that he and Ahmednasir were very close,” Kapila said.
Nyachoti however maintained that he would not pursue that line of questioning.
Another advocate, Fred Ngatia, was also scheduled to appear before the tribunal on Wednesday but it was forced to adjourn after hearing Abdullahi’s testimony as Mutava was absent and could not be reached on phone.
“I think it would only be proper for the judge to be present during this witness’ testimony,” Nyachoti said.
The tribunal will reconvene next Tuesday.
