Kiamba wants EACC barred from seizing his property/file

NAIROBI, Kenya, Apr 6 – Former Nairobi County Finance Officer Jimmy Kiamba has gone to court to protest the attempt by Ethics and Anti Corruption Commission seeking to seize his property which is subject of a criminal case against him.

The troubled officer accuses EACC of concealing material facts arising from a ruling made by Justice Msagha Mbogholi, prohibiting the seizure of his assets.

Kiamba claims that the court having since made a ruling that the anti-graft body cannot be permitted to ask for evidence in a matter that is pending before Chief Magistrate’s court.

Through his lawyer Philip Nyachoti, he told Justice Joseph Sergon that the application by EACC is an abuse of the court process.

Nyachoti said that the commission having been part of the proceedings before Justice Mbogholi, it can’t file an application of similar nature and present it to another judge seeking same orders.

He said that EACC application is meant to frustrate Kiamba why calling for a dismissal for failure to disclose material facts.

”Justice Mbogholi ruling was very categorical that Kiamba having been charged on charges relating to his assets cannot be asked to give incriminating evidence,” the lawyer said.

He applied to have the matter placed before Justice Mbogholi who made the orders dismissing similar application by the commission.

He also wants Kiamba to be given Sh4 million from his bank account for maintenance pending the ruling of the court.
