High Court judge Martin Muya ruled that Mahadi Swaleh alias Jesus and Dyana Suleiman were not involved in the planning and execution of the killings/FILE
MOMBASA, Kenya, March 23 – Mombasa High Court has acquitted two main suspects behind 2014 Mpeketoni terrorist attack where more than 60 people were killed.
High Court judge Martin Muya ruled that Mahadi Swaleh alias Jesus and Dyana Suleiman were not involved in the planning and execution of the killings.
Muya said the prosecution failed to prove beyond reasonable doubt that the two who were facing 60 counts of murder were directly involved in the attacks.
“A lot of resources and manpower were utilised in this case which I find to have been poorly investigated. In conclusion I find that this case has not been proved beyond reasonable doubt against the two accused person on all the sixty counts of murder…the accused person are found not guilty of murder and they are acquitted accordingly,” he ruled.
Dyna was accused of ferrying the attackers from Mombasa to Lamu using two Nissan Matatus that he claimed were hijacked by Al Shabaab to carry out the attack while Swaleh planned eviction non locals with Al Shabaab.
According to the prosecution, the offences were committed during the period between June 15 and 17, 2014 at Kaisari Village and Mpeketoni Township in Lamu County.
