While making their final submissions Monday, the ex-PS, former Chargé d’Affaires at the Japanese embassy Allan Mburu and Former Deputy Director of Administration in the Foreign Ministry Anthony Muchiri claimed the prosecution has not proved any wrongdoing on their part in the purchase of the embassy.
Senior counsel Paul Muite told Anti-Corruption Court Magistrate Kennedy Bidali that the Ministerial Tender Committee made the decision and manner in which the property was purchased.
“Violation of any procurement laws can only be placed on the ministerial tender committee since the prosecution has been unable to demonstrate that on the part of the accused persons,” he argued.
Muite urged the court to find that trio have no case to answer and acquit them of the abuse of office charges levelled against them three years ago.
The three former top government officials have since denied charges of illegal procurement of the multi-million shillings premises without following the laid down procedures.
