Justice Luka Kimaru now wants the controversial MP to pay a further Sh5 million bond or a cash bail of Sh3 million within a week, failure to which he will go to jail.
“’The reasons for enhancing the bond terms is because from the record of the Chief Magistrate’s court, he had been warned not to utter the same words, but the prosecution has demonstrated that he has continued to do so,” the judge said on Tuesday.
This follows an application filed by the Director of Public Prosecutions Keriako Tobiko demanding the cancellation of the MPs bond terms for continued hate speech.
The MP is out on a cash bail of Sh 2 million after denying incitement and hate speech charges last year.
The judge ruled that whereas it is the constitutional right of the accused to be accorded with bond, the same must be honored with all the set conditions.
Kuria had last year lost a bid to bar media from covering his criminal case after the magistrate ruled that there was no evidence provided by the accused to prove that he had been “tried and convicted by the media.”
