NAIROBI, Kenya, Feb 29 – The Judicial Service Commission has constituted a committee to probe allegations of misconduct made against Supreme Court Justices Njoki Ndung’u, Jackton Ojwang and Mohamed Ibrahim.
The Law Society of Kenya petitioned the Judicial Service Commission to look into their conduct after they supposedly went on a go-slow to protest a directive barring fellow Justice Philip Tunoi from hearing cases on account of his age.
The judges have denied ever going on a go-slow but they did rule that the JSC has no power to determine when a judge should hear cases.
A five-judge High Court bench later endorsed their finding by adjudging that the JSC has no power to retire judges as that power falls to head of the Judiciary in the interest of independence.
