In response to Wainaina’s petition, the controversial politician contends that it is in fact Wainaina who attempted to bribe him and there is evidence to prove the same.

Wainaina has moved to the High Court seeking to stop the criminal proceedings on grounds that the Senator had through his brother and two Nairobi politicians solicited the said amount in order to drop the bribery complaints.
It is his argument that the graft charges levelled against him ought to be terminated for want of proper investigations.
The Nairobi Senator insists that the criminal proceedings Wainaina is facing do not emanate from his allegations, but rather the offense of corruptly offering him a benefit so as not expose corrupt activities at the County government.
He now wants the Court to dismiss Wainaina’s suit and hold that he should table the evidence he has during trial.
Wainaina has since denied corruption charges for allegedly attempting to bribe Sonko Sh1 million as an inducement not to pursue a case in which senior officers are purportedly constructing houses using public funds.
The application is now due for hearing on February 13 before Justice Isaac Lenaola.
