NAIROBI, Kenya, Feb 19 – “The Ethics and Anti-Corruption Commission has no moral authority to tell me to appear before them. I will not appear before them to give evidence because I am preparing a petition to compel the commissioners to vet afresh all the staff at the secretariat” – this was Nandi Hills MP Alfred Keter’s response to EACC summons for him to shed light on the loss of Sh791 million from the National Youth Service.

He told a news conference held at Parliament Buildings that he does not have confidence in the Ethics and Anti-Corruption Commission to conduct investigations.

“Are they only doing this because I made noise when they purported to have cleared former Devolution Cabinet Secretary Anne Waiguru? I told them that they rushed the investigations, which were aimed at cleansing someone in the eyes of the public, but it did not work,” Keter said.

He said he will proceed to move a petition calling for the fresh vetting of officers at the EACC Secretariat.

In a letter dated February 16, EACC Director of Investigation Abdi Mohammed wrote to Keter asking him to present himself at Integrity Centre on Friday at 10am.

“It has been widely reported in the media that you have information that can assist this commission in the said investigations. This is therefore to invite you for an interview and statement recording at our offices. We request you to come with any documentary evidence that you may have on the matter,” read the letter.

Keter was informed that his interview and statement would be recorded by John Loikoloi, a Deputy Director for Forensics.

Homa Bay Town MP Peter Kaluma who accompanied Keter said EACC had become a big national joke because of its poor handling of investigations touching on the involvement of Waiguru in the scandal.

“We expect the commission to start in earnest the process of vetting the entire secretariat. Let me tell them not to sit back and wait for the parliamentary action initiated by Honourable Keter. The secretariat was a bunch of stooges for the Executive, covering up for the people the government wants to protect and indeed extorting money and rent-seeking in the pretext of conducting investigations,” he said.

The Nandi Hills MP said he will petition Parliament to compel the newly appointed EACC Chairman Phillip Kinisu to expedite the process of screening staff at the commission’s secretariat, headed by Chief Executive Halakhe Waqo.

The first-term MP said he was concerned the commission is fast losing public confidence in the fight against corruption, especially after it cleared Waiguru of any wrongdoing in the loss of funds at the National Youth Service.

Keter accused the Commission of conducting sloppy investigations.

“We have lost money at NYS, some of us have evidence…If EACC were interested in evidence and witness statements then they should have interrogated some of us who have evidence that involves CS Waiguru directly in what happened,” he said.
