DPP orders 4 policemen charged with murder

NAIROBI, Kenya, Jan 8 – Director of Public Prosecutions Keriako Tobiko wants four police officers charged with murder as recommended by the Independent Policing Oversight Authority in two different cases.

In the first case, a police constable who was formerly based in Makongeni Police Station within Nairobi County has been accused of killing Bernard Ogutu, a Nairobi resident who was unarmed, on September 25, 2013.

According to IPOA, the killer cop walked into a guest house where he found the victim who was headed to the bathroom and without identifying himself engaged him in a quarrel which resulted in the killing.

“At the time, Police Constable Korir was not in police uniform but was armed with a police pistol which he used to shoot and kill Bernard. IPOA investigations also established that there was no robbery or any criminal activity on that day at Carmel Guest House and Bernard was not armed as alleged by Constable Korir,” reads a statement by IPOA.

“Further, despite having his national identification card, police labelled Bernard as an unknown person in police and mortuary records. Bernard’s body was later taken to City Mortuary by police officers.

Upon conclusion of the investigations, the authority forwarded the case file to the Director of Public Prosecutions with a recommendation that Constable Rajab Korir be charged with murder. The DPP concurred with IPOA’s recommendations and has directed that Constable Korir be charged with the murder of Bernard Ogutu.”

The other case is of three police officers accused of killing Caren Chepkoech, a resident of Nakuru County.

IPOA investigations revealed that the Chepkoech died in a police vehicle while in the custody of the three officers.

Further investigations revealed that she died as a result of a serious injury to the back of the head and she had no other marks or injuries on her body, different from what the police had claimed.

“The investigation revealed that Caren Chepkoech died in the back of a police vehicle while in the custody of Corporal Silas Mutuma Marimi, Police Constable Reuben Maino and Police Constable Wycliffe Wangila Sikuku who were based at Olenguruone Police Station, Nakuru County. Investigations established that Chepkoech was arrested by the Police Officers on 8 July 2014 at around 2am at Wagon Bar where she was working as a barmaid,” Oketch pointed out.

The officers took Chepkoech to Olenguruone sub-district hospital claiming that she had jumped out of the moving vehicle in an attempt to escape from lawful custody, and fell on the tarmac sustaining head injuries.

Investigations revealed that Chepkoech was dead by the time she reached the hospital and the injuries she had sustained were not consistent with the story given by the officers that she jumped from a moving vehicle.
