A video clip that has gone viral captured Shahbal saying that Jubilee would win the next election “by buying or stealing votes.”
He also stated that the Jubilee Party would win the 2017 General Election by force.
According to the DPP, the words uttered amount to a criminal offence under the elections and criminal laws.
“My attention has been drawn to a video clip posted on the website of the Star, Kenya, in which the above mentioned person is captured uttering words that may amount to criminal offenses under our elections and criminal laws,” Tobiko stated.
In a letter copied to the Independent Electoral and Boundaries Commission Chairman Issack Hassan, Tobiko directed the Inspector General of Police to interrogate Shahbal and conduct speedy investigations into the utterances.
“This is therefore to direct you to cause the said person to be immediately interrogated and speedy investigations conducted into the offensive utterances and the resultant inquiry file forwarded to this office without delay for perusal and appropriate action,” the DPP said.
Shahbal recently joined the Jubilee Party after defecting from Wiper.
He contested for the Mombasa gubernatorial seat in 2013 but lost to Ali Hassan Joho.
Nairobi ODM chairman George Aladwa has been on the spot for utterances described as amounting to incitement to violence.
He was captured on video allegedly saying people would have to die for CORD leader Raila Odinga to become president in 2017.
Gatundu South MP Moses Kuria was also on the spotlight late last year after remarks he uttered in Murang’a.
Kuria had been accused of having posted inflammatory remarks in a Facebook conversation that caused a public.
