NAIROBI, Kenya, Nov 18 – The Senate Legal Affairs and Human Rights Committee was forced to adjourn a meeting to discuss a petition accusing Machakos Governor Alfred Mutua of mistreating his deputy, after it emerged that a similar matter was before court.

Chairman Amos Wako suspended the sitting to Monday next week when lawyers representing Mutua and Deputy Governor Bernard Kiala furnish the committee with details of the status of the matter in court.

“We cannot rule until we know what is happening in court,” stated Wako.

The committee learnt that Kiala had sought ex-parte orders against Governor Mutua whom he accused of withdrawing his official car, security guards attached to him, denied him his allowances and restricted access to his office.

Senators then put the seemingly unprepared Kiala to task over why he had failed to notify Speaker of the Senate over the fact that the matter was in court since the issue would be sub-judice.

“You ought to have known and informed the Speaker that this matter is in court,” said Wako.

“There has been an oversight on my part not to mention this to the Speaker, but it was not intentional; I was desperate,” apologised Kiala.

He said he was keen on ensuring the matter was handled as soon as possible since his term was coming to an end in 2017 claiming there could have been a plot to delay the process.

“I am serving a limited term,” he lamented.

“It is hurting for me, so I want us to do this as soon as possible.

Kiala who was accompanied by four Members of the County Assembly first petitioned the Senate on June 25, 2015 before amending it and presenting more prayers in a petition submitted on September 24.

In the petition, Kiala wanted the Senate to compel Mutua to provide him with minutes of all the Executive meetings held in his absence, provide him with an official car befitting the status of Deputy Governor, pay security guards attached to him, pay him all the outstanding allowances and to also reimburse all the expenses incurred while on official duty.

In his defence, Mutua accused Kiala of absconding his duties and engaging in meaningless political rhetoric and describing him as “dishonest, untruthful and one acting out of ill-will.”

He said the allegations that Kiala had not been invited to any Cabinet meetings were false stating that the motive by the Deputy Governor in demanding minutes of meetings were suspect.
