The order was issued on Thursday by Justice Anyara Emukule who ruled that the State had failed to demonstrate sufficient reasons to freeze the accounts.
He also nullified a Gazette Notice that linked the two human rights organisations to terrorism.
Justice Emukule ruled that the prosecution did not provide sufficient evidence to prove that the two organisations were involved, facilitated or supported terrorism activities in any way.
The State has indicated that it will appeal against the ruling.
The organisations’ bank accounts were frozen eight months ago soon after the government kicked off an investigation on several Non-Governmental Organisations it accused of being associated with, or funding terrorist organizations in the country.
Haki Africa’s Executive Director Hussein Khalid on Thursday said he was delighted at the court ruling.”Justice has prevailed,” he said in a statement, “This is not just a win for the organisations and civil society but for the constitution and the people of Kenya.”
He said the action by the government had greatly hampered their operations because they could not access funds for their day to day operations.
“We have been vindicated by the courts and as an organisation, Haki Africa is now even stronger than ever to champion for the progressive realization of human rights in Kenya and beyond,” he said in a statement from The Netherlands.
