NAIROBI, Kenya, Oct 5 – A Nairobi court has released ‘doctor’ Mugo wa Wairimu who allegedly raped a woman at his clinic on cash bail of Sh1 million.

Nairobi Chief Magistrate Daniel Ogembo directed Wairimu to deposit an alternative surety bond of Sh5 million and the case will be mentioned on October 19.

At the same time the court ordered the accused not to interfere with prosecution witnesses. Wairimu was last Friday charged with 12 counts, including rape and operating a clinic without a license.

He was also charged with masquerading as a gynecologist, with full knowledge that he was not qualified as one.

Senior State Counsel Jacinta Nyamosi had told the court, the 14 days granted by the court two weeks ago were not sufficient enough to conduct investigations given the magnitude of the offence.

She said that there are key areas that have not been covered by the police so as to make a determination on which more charges to prefer against the suspect.

Nyamosi said that there are two key witnesses who have not recorded the statements and they are currently outside Nairobi.

The investigating team is still waiting reports from the University of Nairobi, government analytical laboratory in regards to DNA extracted from the suspect and other samples that were picked from various areas.

The prosecution last week opposed his released on bail arguing that “owing to nature of the crimes that Wairimu is alleged to have committed and the vulnerability of the victims it is in the interest of justice that the suspect remains in police custody.”

The court heard that investigators have so far obtained records from the Kenya Medical Practitioners and Dentist Board, Pharmacy and Poison Board, Nursing Council of Kenya, Kenya Medical Laboratory, Technicians Board, Radiation Protection Board and medical examination for checking up who examined the suspect.

Wairimu was arrested on September 10 in Limuru and was taken to the court the following day where police were granted 14 days to carry out investigation into the allegation of rape.
