NAIROBI, Kenya, Oct 2 – James Mugo Ndichu alias Dr Mugo Wa Wairimu has been charged with 12 counts that include rape and the administration of a substance with the intent to commit rape.

Mugo has denied the charges that also include operating a clinic without a license and masquerading as a medical practitioner.

He’s also denied operating a laboratory and pharmacy without a license, employing an unregistered technician and operating radiation equipment without a license.

Mugo remains in police custody until Monday when Chief Magistrate Daniel Ogembo will rule on his application for release on bail.

Mugo has been in police custody since his arrest on September 10 and the prosecution on Friday maintained its opposition to his release.

In an affidavit, investigating officer Andolo Munga made the case for Mugo’s continued detention citing the defendant’s safety. “A real risk knowing the public’s outrage following the events that led to the investigations.”

Another reason given for Mugo’s continued detention was the fact, the prosecution submitted, that he went into hiding, closing his clinic when accusations first surfaced that he made unconscious then raped a woman who went to his clinic for a consultation.

“A resident of Nairobi, he was eventually arrested in a hotel in Limuru,” Munga submitted.

When reports emerged that Mugo was suspected of abusing the sick, residents of Githurai 44 where his clinic was located, threatened to burn it down.

“These stories are not new. Women have been complaining. We fear the clinic may not be shut down, that is why it is better for us to destroy it. We just be allowed to go in and remove those beds and computers,” one resident told Capital FM News.

The “vulnerability of the complainants/victim(s)” was another reason Munga put forward in opposition to Mugo’s release.

Mugo through counsel Cliff Ombeta on Friday opposed his continued detention terming it a violation of his right to freedom on the premise that he is innocent until proven guilty.
