NAIROBI, Kenya, Oct 8 – National Assembly Speaker Justin Muturi says Parliament has not been served with a court order blocking debate on an impeachment motion against Devolution Cabinet Secretary Anne Waiguru.

The order was obtained last week by the Commission for the Implementation of the Constitution which argues that Parliament has no role in impeaching Cabinet Secretaries.

“People, who have not seen what is said to be a ruling, may be telling us there is a ruling when actually there is none. Why would we not be served by now if indeed there was a ruling?” Muturi posed.

He however maintained that legislative matters must be left to Parliament to dispense. “The only thing we know that the House cannot debate is matters sub-judice.”

The Speaker said: “Remember there are matters reserved for the Legislature, nobody purporting to be speaking with authority can dictate to Parliament what it should do. Do they tell us how to deal with budgets and yet we deal with budgets? We are not toddlers.”

The CIC on Monday successfully sought orders to bar MPs from debating the motion.

The Speaker also indicated he had not received the motion on Waiguru’s impeachment despite Nandi Hills MP Alfred Keter having been quoted saying he has already submitted it to the Clerk of the National Assembly.

“You heard me on the floor saying, that even if it is about me, I will process it very quickly and I have done so. I mean, surely if I have done so about me, why not process one about other state officers?” he said while fielding questions from journalists who sought to know if his office had received the Waiguru ouster motion.

Thirty legislators allied to the Jubilee Coalition led by Leader of Majority Aden Duale dismissed the motion by Keter pushing for the impeachment of Waiguru over alleged corruption at her ministry, saying it was a diversionary tactic by the Opposition which has been accused of being behind Deputy President William Ruto’s ICC woes and bent on splitting the Jubilee administration.

“We want to confirm that Alfred Keter does not represent the views of the members of the jubilee Coalition, he does not speak for us. His history within our coalition is known to all and sundry from the Standard Gauge Railway to what happened in the weighbridge in Gilgil,” said Duale.

While accusing the Nandi Hills MP of being a mole and serving the interests of the Opposition, Duale rooted for Waiguru insisting she was a whistleblower saying Keter was being used to divert attention from the pronouncements by Gatundu South MP Moses Kuria linking powerful opposition legislators to the recruiting of witnesses to fix DP Ruto.
