The DPP had in May, rejected preferred charges against Kambi as par the recommendation of the EACC saying there was no sufficient evidence.
“The EACC has now on its own motion resubmitted the file requesting the DPP to reconsider the matter and charge the Cabinet Secretary as earlier recommended,” read a statement from DPP Keriako Tobiko.
Tobiko said the re-submitted file ‘shall be independently re-evaluated and decision thereon made based on the evidence and the law.’
Kambi’s allegations stem from the irregular appointment of Andrew Gichamba Muigai and Veska Jepkemboi Kangongo as members of the NSSF Board.

In March, the President suspended five Cabinet Secretaries- Charity Ngilu (Lands), Michael Kamau (Transport), Kazungu Kambi (Labour), Davis Chirchir (Energy) and Felix Koskei (Agriculture) and four PSs – Nduva Muli (Transport), Mutea Iringo (Defence), Patrick Omuita (Mining) and James Teko (Water).
Only Ngilu and Kamau have been taken to court over the allegations, while Kambi and Koskei have been cleared by the DPP.
The EACC in September cleared Chirchir’s allegations that he and Kenya Power Managing Director Ben Chumo colluded to embezzle Sh90 million transferred from the Kenya Pipeline Company to Kenya Power.
Kamau’s charges are related to allegations that Kundan Singh Construction Company Limited, resident engineer and other public servants involved in the ongoing construction of Kamukuywa-Kaptama-Kapsokwony-Kimili Road colluded by trashing aside a consultants design without following the proper procedures and redesigning the road leading to massive embezzlement of funds.
