Residents sue Muthama for inciting public against Mutua

NAIROBI, Kenya, Sep 2 – Two residents of Machakos County have sued Senator Johnson Muthama for inciting the public against Governor Alfred Mutua.

Martin Musyoka and Peter Joseph Mutiso accuse Muthama, and Athini Holdings Limited – a company associated with the politician – of continuously making statements meant to incite the people of Machakos County against Mutua.

They contend that Muthama has been making statements in the public against the development projects initiated by Governor Mutua and make reference to claims by the Senator that borehole commissioned on July 29 was incomplete and that water was carried in a tractor.

The two accuse Muthama of alleging that tractors purchased by the Machakos County Government are bogus and that seeds distributed to the farmers in the county never germinated.

Muthama is also said to have misled the people of Machakos County that Governor Mutua has 96 cases pending before the Senate over mismanagement of public funds and abuse of office.

The petitioners urged Justice Mumbi Ngugi to restrain the politician from making further remarks concerning Governor Mutua pending hearing and determination of the case.

They contend that unless the orders are granted, county developments projects currently are likely to stall and the people will be adversely affected.

The court did not grant any orders but directed the residents to serve the petition on the respondents to facilitate an inter-partes hearing next Wednesday.
