Nkaissery wants Muthama probed over Waiguru remarks

NAIROBI, Kenya, Sep 25 – Interior Cabinet Secretary Joseph Nkaissery has now ordered Machakos Senator Johnstone Muthama to record a statement with the Criminal Investigation Department over remarks he made at a CORD rally in Uhuru Park on Wednesday, seen to undermine the authority of President Uhuru Kenyatta.

Nkaissery has also directed the National Cohesion and Integration Commission (NCIC) to commence investigations on the utterances by Muthama which, he said, were choreographed to stir ethnic hatred against the President called for prompt investigation.

“Muthama has made a habit of verbally attacking state officers in a manner that is intended to undermine cohesion and national unity for political gain,” he said in a statement, “Calling Kenyans to violence and readiness to ‘die to defend their rights’ is serious because it contravenes the basic tenets of the Constitution.”

He pointed out that although the constitution gave every Kenyan the freedom of expression, the right should not be abused.

In his speech, Muthama spoke at length about corruption allegations in government, mainly touching on Devolution Cabinet Secretary Ann Waiguru while questioning why she is still in government.

Nkaissery stated that the speech which has been doing rounds on social media brought disrepute to the office of the President, undermined the stability of the country and had the potential to cause uncertainty, tension and threatens national security.

The focus of investigation will be on the calls for unconstitutional change of government, the claims that President Kenyatta interfered with Burundi’s constitutional dispensation, statements that undermined the authority of a public officer, the use of salacious, obscene, crude, lewd and vulgar language against state officers and undermining the National cohesion Act by describing the President as bent on ensuring the children of the poor remained poor.

During the rally, Muthama made references to Waiguru and the Presidency in a manner that, Jubilee MPs have said, was derogatory and amounted to hate speech.

“That an elected official, a member of the Senate no less would choose to unfairly and misleadingly make such inflammatory statements should not pass without action,” said the Interior CS.

Jubilee MPs led by The National Alliance party Chairman Johnstone Sakaja have called for the immediate arrest of Muthama, saying if action was not taken, they would initiate a citizen’s arrest.

The MPs urged the Director of Public Prosecutions to take action on Muthama, further calling on the senator to tender a public apology to Kenyans.

“It was shocking to see a ‘purportedly’ grown man stand up in front of children and insult with sexual innuendo a respectable Cabinet secretary of the Republic of Kenya. That was an insult to not only Ann Waiguru but to all women,” said Sakaja.

Dagoretti MP Dennis Waweru said he has since written to the National Cohesion and Integration Commission (NCIC) to initiate action on the Machakos Senator and also instructed his lawyer to launch a lawsuit against him.

Several women MPs have also lashed out at Muthama for the remarks, which sparked protests outside parliament on Friday.

“The opposition will never lead this country if it treats women the way it did in Uhuru Park yesterday,” said Senator Beth Mugo.
