NAIROBI, Kenya, Sep 22 – Former Finance Minister David Mwiraria has been summoned to appear in court on November 23 for purposes of taking a plea in the Sh10 billion Anglo Leasing scandal case.

Chief Magistrate at the anti-corruption court Felix Kombo issued the summons, after he was informed that Mwiraria can stand trial.

The medical report from Kenyatta National Hospital indicates that Mwiraria was taken ill when the Director of Public Prosecutions made the recommendation that he be charged alongside Deepak Kamani, his brother Rashmi Kamani and their father Chamanlal Kamani.

The trio has already denied having participated in the Anglo Leasing Scandal.

Last week, the Kamani family lost a bid to have the criminal case quashed, after the judge found that no sufficient evidence was adduced to demonstrate that they will not get fair trial.

Justice George Odunga said that the allegation brought against them can only be determined by the trial court as the judicial review court cannot interfere with the matter.

Justice Odunga further said that from the evidence shown, despite the fact that former AG Amos Wako gave an opinion over the contract it would appear that fraudulent acts happened during the execution of the contracts.

The judge further held that he cannot overturn the decision of the DPP to charge them without evidence being adduced.

The companies listed as having benefited from the multi-billion contracts were Sound Day Corporation, Apex Finance Corporation, Anglo Leasing and Finance Limited, Infotalent Limited, Globetel Incorporated and Midland Finance and Securities Limited.

The Anglo Leasing contracts which link the Kamani family to corruption case was signed with the consent of several former government ministers.

Last year, the accused moved to court to stop the Kenyan government from releasing information to the Swiss authorities in relation to the controversial Anglo Leasing contracts.

They are linked to companies that were awarded 13 out of 18 Anglo Leasing security contracts.
