NAIROBI, Kenya, Sep 21 – Gatundu South MP Moses Kuria got reprieve after the High Court on Monday declined to revoke his Sh2 million bond in hate speech case, arguing that the Director of Public Prosecutions (DPP) relied on hearsay in seeking cancellation.

Trial Magistrate Teresia Nyangena said the court found that the DPP had not presented evidence to demonstrate that Kuria committed the offence.

The court had been told that after Kuria was released on bond on the charge of incitement, he had continued to spread hate speech and incite members of the public.

The DPP said Kuria should be held in custody pending the hearing and determination of his case to restrain him from spreading hate speech.

The DPP last June ordered for the prosecution of Kuria after the National Cohesion and Integration Commission recommended for him to be charged with three different counts of incitement to violence.

He was accused of posting inflammatory remarks in a Facebook conversation.

According to the State, his remarks amounted to incitement to violence by implying that it is desirable to bring death and physical injury to a class of persons in Kenya.

On June 23, he appeared before Chief Magistrate Doreen Mulekyo but denied the offences.

He was released on a bond of Sh2 million and an alternative surety bond of Sh5 million.
