NAIROBI, Kenya, Aug 17 – The Director of Public Prosecutions Keriako Tobiko says he will make a final decision on whether and what to charge Apostle James Ng’ang’a with by Wednesday following a fatal accident in Limuru.

He however says they are “likely to prosecute” over the accident that led to the demise of wife and mother Mercy Njeri, last month.

Tobiko told Capital FM News on Monday that his office in collaboration with the investigating officers “have been working to tie up loose ends in the file” handed over to him by Inspector General of Police Joseph Boinnet last week.

He says the majority of the gaps in the file have been addressed and the process should be completed in the next one to two days.

Ng’ang’a has been accused of allegedly being behind the wheel of a Range Rover which collided with a saloon car in which Mercy was a passenger.

According to witness reports, Ng’ang’a caused the accident as he was driving on the wrong side of the road at high speed and later fled the scene.

Tigoni police had placed one Simon Maina Kuria behind the wheel of the Range Rover and while he was arraigned before the Limuru Law Courts, he did not take a plea after Boinnet ordered a re-investigation.

“In response to the mass of information provided by members of the public to the media that suggested that the information provided by the traffic officers at Tigoni may not be entirely correct, I dispatched a special team to the scene to verify the same.”

The special team was led by Traffic Commandant Charlton Muriithi who was tasked with determining whether the Tigoni police were indeed involved in a cover-up to shield Ng’ang’a from prosecution.

Other questions that remain surrounding the accident are whether the Range Rover was insured at the time of the accident and whether or not a thorough inspection was conducted before its release from police custody.
