Wamalwa believes officers from the EACC were sent to his Kiminini CDF Office to harass them because of the amendment which is now waiting Presidential assent to come into law.
“Many members have also been harassed over the same, because there is a purported allegation that MPs passed that amendment because they were corrupt. This is like intimidation and harassment so we want to be assured whether in this House we are legislating freely or there’s another force of impunity somewhere that is trying to intimidate and harass MPs,” he said.
On July 9, MPs voted 70 – 39 in support of the amendment proposed by Wamalwa which sought to have the offices of the Secretary and the Deputy Secretary become vacant upon the enactment of the Bill.
Wamalwa however stated that both Waqo and Mubea will not be required to leave office immediately but will continue serving in acting capacity pending the appointment of the substantive holders.

MPs Samuel Chepkonga (Ainabkoi), Robert Pukose (Endebess) and Nicholas Gumbo (Rarieda) said it is improper for the Commission to unfairly target MPs for performing their mandate while Lamu West MP Julius Ndegwa who is facing charges over misuse of CDF called for the disbandment of the anti-graft body.
“For somebody to harass MPs it is uncalled for, it unacceptable and it will be resisted by my Committee,” said Chepkonga, who chairs the House Committee on Justice and Legal Affairs which oversees the EACC.
Pukose and Ndegwa (Lamu West) said corruption has been a critical issue and therefore a need for a clean start at EACC.
“I am one of the people who opposed that Motion, but today I am very sad that it can degenerate into this level where Hon Wamalwa is being witch-hunted. I can assure them that should it even be brought back, I now see a reason why that secretariat needs to be vetted afresh,” the Endebess MPs said.
“These people should be treated like how we treated the ECK and they be disbanded as the whole body,” Lamu West MP added.
Ugunja MP Opiyo Wandayi and Jubilee Coalition Deputy Minority Whip Benjamin Washiali urged Wamalwa to co-operate with the investigations instead of personalizing the probe.
Wandayi cautioned MPs’ that their overture might be interpreted as sabotaging Kenyatta’s anti-graft war.
“It will be very difficult for us to judge what’s happening between the EACC and my friend, Hon Wamalwa, this House is under the spotlight and we can easily fall into a trap and be treated as House which is overtly against the anti-corruption efforts,” Wandayi said.
