Kuria has called on the chairman of the National Cohesion and Integration Commission (NCIC) Francis ole Kaparo to instruct the police to arrest Kidero and Khalwale with immediate effect for propagating ethnic based violence and incitement. 
NAIROBI, Kenya, Jul 20 – Gatundu South Member of Parliament Moses Kuria wants Nairobi Governor Evans Kidero and Kakamega Senator Boni Khalwale prosecuted for the chaos that occurred last week at the Milimani Law courts.
The MP indicated that if NCIC fails to act, he will initiate private prosecution against the two.
“It is instructive to note that Dr Khalwale has been summoned by NCIC before but he refused to appear, even pouring scorn and contempt on the commission. This time round I hope Mr Kaparo will be more assertive and forthright in taking action against these two CORD leaders. If Mr Kaparo does not take action against Dr Kidero and Dr Khalwale, I will be carrying out private prosecution against the two in to safeguard our country, our future and that of our children,” he said.
According to the Gatundu South legislator, Friday’s incident was an indication that the two do not deserve to be leaders.
“On the first day of the violence, Dr Khalwale was on the receiving end. So vicious were the Kidero gangs that Dr Khalwale had to hide himself in a toilet. On the second day of the ethnic violence, Dr Kidero’s goons pelted Khalwale’s goons with stones. According to Dr Khalwale, they met matching force from the ‘Children of the Omoluhyia’,” he stated.
Kuria described it as worrying that police were forced to shoot in the air to disperse the rival militia right outside the Milimani Law Courts.
Police on Friday lobbed teargas and shot in the air to disperse supporters of the two.
The two groups confronted each other following a ruling by Justice Joseph Sergon who gave further orders barring the Kakamega Senator from linking Kidero to the collapse of Mumias Sugar Company.
Kuria is himself in trouble with the NCIC for inciting remarks he made in his constituency a fortnight ago.
Kuria was summoned after a video went viral on social media in which he is captured telling youths to use machetes he had provided to chop anyone opposed to NYS projects.
The MP who has in the past been arraigned before court on charges of hate speech initially said he was unapologetic over the remarks and added that his remarks were brought about by opposition to NYS projects.
