NAIROBI, Kenya, Jun 4 – Embakasi North Member of Parliament James Mwangi Gakuya was on Thursday charged with defrauding his Makadara counterpart Benson Mutura Kangara of Sh7 million.

Gakuya who denied the charge, is accused of transferring the lease for a parcel of land in Kasarani that did not belong to him to Kangara for the Sh7 million.

“On unknown dates between December 2013 and March 23, 2014 at Thome Estate within Kasarani sub-county, jointly with another not before court conspired with intent to defraud offered for sale parcel of land NAIROBI/BLOCK 110/424 by falsely pretending that you were the genuine owners of the said parcel of land,” court documents read.

Gakuya has therefore been charged with three counts of obtaining money by false pretence, uttering a document with intent to defraud and conspiracy to commit a felony.

Kangara is one of those set to testify against his brother in chambers who not only risks a prison sentence, but risks losing his seat should he be found guilty before his term ends.

Gakuya was released on a Sh5 million bond with the alternative of paying Sh1 million in cash bail.

His case will be mentioned on June 15.
