Tobiko however warned of ramifications if the officials are charged.

He said he was not satisfied with evidence gathered by EACC detectives who had recommended the prosecution of the officials.

“DPP not being satisfied with sufficiency of the evidence and considering the obvious ramifications of charging the chairman and commissioners of NPSC on the work of the commission including the recruitment, promotion and discipline of police officers and the ongoing vetting process directed that the chairman and commissioners be held individually and collectively (including surcharged) for any loss or damages that may result from their failure to follow procurement laws,” he said.

According to the DPP, the EACC further recommended for the officials of public works involved in the evaluation process and also those associated with the firm that was awarded the partitioning contract be charged.

Tobiko directed that the 10 NPSC officials be warned against getting involved in procurement processes of the commission.

At the same time he said disciplinary action be taken against the public works officials ‘including possible dismissal from public service.’

He advised the commission to consider advice of the Attorney General and halt the partitioning contract which was the subject of investigation, as well as the prosecution of the public works official who approved it.

Tobiko also approved for the Youth Enterprise Development Fund acting CEO to be charged for approving the procurement of hatcheries at the cost of Sh200 million and signing the addendum without seeking approval from the board as required.

The DPP will make a decision on three other files, one, involving procurement of land cruisers for the Machakos County Executive members through single sourcing.
