The commission has also asked the Director of Public Prosecutions (DPP) to hand over his file to the Senate to undertake disciplinary action.
“With regard to the Penal Code offences disclosed, EACC recommends that the matter be referred to the DCI for appropriate investigations. With regard to the disclosed violation of Chapter 6 of the Constitution, EACC recommends that the matter be referred to the Senate for appropriate action,” EACC stated.
Sonko is subject of investigations over multiple allegations.
He is also being investigated for allegedly colluding with suspended Lands Cabinet Secretary Charity Ngilu and businessman Deepak Kamani in a land grab ring involving senior ministry officials, politicians and brokers including Patrick Kibagendi Osero, lawyer James Mbaluka and Chief lands officer Sarah Mwenda.
He was also named in a corruption scandal at the Kenya Pipeline Company involving suspended Energy Cabinet Secretary Davies Chirchir where they are accused of being involved in a raft of corruption deals in the Ministry’s tender and procurement process.
Sonko was the first elected leader to step aside following a directive in which President Uhuru Kenyatta asked all those mentioned in the corruption grand list to step aside and wait for investigations.

Some 175 individuals including Cabinet Secretaries, Members of Parliament, Governors and other top brass government leaders were named in the list.
Four files involved Ngilu, Infrastructure and Transport Cabinet Secretary Engineer Kamau and Labour Cabinet Secretary Kazungu Kambi are awaiting the decision of Director of Public Prosecutions.
EACC recommended that Kambi and Kamau be charged while it asked that Agriculture Cabinet Secretary Felix Koskei as a witness in an allegation that he had cultivated on a 100 acre piece of government land.
The commission however, recommended for the closure of the file against Ngilu.

EACC Chief Executive Officer Halakhe Waqo on Sunday announced that it was not possible to complete all the 175 files by the deadline set by President Uhuru Kenyatta.
President Kenyatta had ordered that investigations be done within 60 days which ended on May 26.
