Prosecutor wants bail on rape suspect MP cancelled

NAIROBI, Kenya, Apr 8 – The State on Wednesday morning applied to have a cash bail of Sh100,000 granted to Imenti Central MP Gideon Mwiti cancelled, on grounds that he is intimidating witnesses.

Mwiti who is charged with raping and assaulting a woman known to him, was in court for the mention of his case.

His lawyer John Khaminwa objected the State application, which he termed as baseless. The magistrate was to make a determination on the matter on Wednesday afternoon.
Mwiti was last week charged with rape, assault and intimidation before Milimani Resident Magistrate Edah Agade.

He was released on a cash bail of Sh100,000 following an application by his lawyer Khaminwa who explained that Mwiti was diabetic hence it was difficult for him to continue staying in custody.

He also said the presumption of innocence should be considered in the plea for a cash bail.

Khaminwa further pledged that his client would cooperate with the court and appear whenever summoned. The victim’s lawyer was however opposed to the cash bail on argument that Mwiti would interfere with witness if he would be set free.

Agade however, ruled in favour of Mwiti and released him last Thursday after spending a night at the Kileleshwa Police station.
