Speaker of the National Assembly Justin Muturi said the petition by Nairobi lawyer Geoffrey Oriaro wants Parliament to start the process of removing the two over alleged violations of the Constitution.
“The petition states that Mr Mumo Matemu and a member Ms Irene Keino of the EACC are in serious violation of the Constitution and the Ethic and Anti-Corruption Act and Anti-Corruption and Economic Crimes Act and the Penal Code. They have shown gross misconduct in the performance of their duties as commissioners and last they are incompetent in the management of the commission,” Speaker Muturi told the House.
Differences at the commission came to the fore after the commission’s CEO Halakhe Waqo reinstated his deputy Michael Mubea hours after he had been suspended by Matemu.
In his petition, Oriaro accuses Matemu of incompetence and failure of leadership and wants the House to recommend the formation of a tribunal to probe his conduct.
“The petitioner prays that this House discloses the grounds of the removal of the named chairperson and commissioner under Article 251 of the Constitution and that the National Assembly recommends to His Excellency the President to appoint a tribunal to investigate the named chairperson and commissioner in accordance to Article 251(iv) of the Constitution,” the Speaker added.
The National Assembly shall consider the petition and if it meets all the requirements, shall then make a decision, which should be communicated to the petitioner in a fortnight.
“The work of the committee is to guide the House in form of a report, on whether the petition satisfies the ground for the removal of a member of a constitutional commission. The committee has 14 days within which to submit the report to the House. Once the committee tables its report, the House will have 10 days to decide whether or not the petition contains valid grounds for the removal of a chairperson and member of the commission,” the Speaker said in his communication.
