EMBU, Kenya, Mar 18 – Embu County Assembly Deputy Speaker Ibrahim Swaleh has been arraigned in court but was not required to plead in a case where he’s linked to a murder conspiracy.

Embu Senior Principal Magistrate Paul Biwott released Swaleh on a Sh100,000 cash bail and ordered him to report daily to the Embu County CID boss for the next six days. The Kirimari MCA surrendered himself to the police, after summons were issued to him on Tuesday.

He is considered a key link in a case where a mother and her son are accused of conspiring to murder an Embu businessman.

Swaleh was interrogated for over two hours before being taken to the Embu Law Courts under tight security.

The investigating officer Robert Kering told the court that they had evidence that Swaleh was the prime suspect in the conspiracy to murder Morris Muchiri Nyaga but needed more time to piece up the evidence.

He unsuccessfully applied for Swaleh to be held at Karatina police station for six days alleging he would interfere with the evidence or abscond.

Swaleh’s lawyer, David Njoroge, said his client’s constitutional rights would be infringed if he was held in a far flung police station or held while he had not been charged.

Biwott concurred with him that the prosecution had not demonstrated evidence that Mr Swaleh would abscond or interfere with the case since he had presented himself to the police.

“He cooperated by presenting himself to the police and he is just a mere suspect since he has not yet been charged,” he ruled.
The case will be mentioned on March 25.
