He said once the Ethics and Anti Corruption Commission (EACC) finalises with the investigations, he will be ready to take action.
“I have not yet prosecuted anyone because the file has not been forwarded to me. But I have confirmed from them (EACC) they are on it with active investigations and once they finalise they will forward the file to me and I will make a decision based on the evidence,” Tobiko said.
The Southwark Crown Court in London jailed two officials of UK security printing firm Smith and Ouzman (S&O) found guilty of bribing IIEC officials.
Nicholas Smith and his father Christopher will serve about three years in jail for their involvement in the corruption scandal involving top managers of the then Interim Independent Electoral Commission (IIEC).
IEBC Chairman Issack Hassan, former IEBC Chief Executive Officer James Oswago, former commissioner and currently Energy Secretary Davis Chirchir are among former IIEC officials mentioned in the scam.
Meanwhile, former Prime Minister Raila Odinga lashed out at the government wondering why Kenya had not yet charged officials mentioned in the scam yet the UK has done so.
He said they should be charged and imprisoned.
“People have eaten ‘chicken’. In the U.K they have arrested people and sent them to jail for three years because they bribed some Kenyan people. In Kenya we are told they are investigating because there is no evidence, what investigations are they carrying out when U.K have investigated and sentenced people? Show Kenyans by actions,” he said.
Odinga said those behind the scam should be arrested and sent to prison; “You ate chicken, now go to prison and eat beans.”
