ICC judges accept Waki report in Ruto, Sang case

A member of the Waki Commission, Gavin Alistair McFadyen who appeared as an expert witness in the trial against Ruto and Sang on July 11 last year told the ICC judges that violence in the Rift Valley was planned.

The witness, who said the CIPEV report was a reliable copy, further told the ICC judges that Ruto’s name was among the eight contained in the infamous ‘secret envelope’.

McFadyen told the court that former Information and Communication Permanent Secretary Bitange Ndemo gave evidence to the Waki Commission and also provided broadcast transcripts of Sang’s show.

The prosecution made an application for all the 12 documents to be admitted but only the Waki report which investigated the 2008 Post Election Violence has been admitted as documentary evidence in the charges against Ruto and Sang.

The Waki report which ICC will rely on contains extensive information on how violence was carried out following the disputed 2007 presidential poll.

It is a controversial document that has sparked debate with demands for the eight people named publicly.

A document by the National Security Intelligence Service was also previously admitted as evidence.
