NAIROBI, Kenya, Feb 3 – The owner of a popular nightspot in Nairobi’s Buru Buru estate who is accused of killing his wife has been denied a bail by the High Court.

Judge Luka Kimaru declined to release Erastus Ngara Odhiambo alias Ediot, saying he is likely to interfere with potential witnesses as argued by the prosecution.

The judge further directed crucial witnesses to testify first before the businessman can renew his application for bail.

He will remain in custody until October 12 when trial will commence and proceed for three consecutive days.

Prosecuting Counsel Catherine Mwaniki had objected to his release on bail arguing that three potential witnesses will be in real danger.

The court was told that if Odhiambo is freed on bail he is likely to inflict danger on Diana Irungu, sister of the deceased, a watchman and the house help who witnessed the alleged shooting.

Odhiambo has denied killing 27-year-old lawyer, Linda Wanjiku Irungu, on the night of December 12, 2014 at Waihura Court, Buru Buru Phase V.

“The prosecution prays that the accused be detained until the testimony of the key witnesses is procured because if released on bail he will inflict real danger on them,” the prosecutor argued.

Odhiambo is a licensed firearms holder and is believed to have shot the deceased from behind and kicked her several times in the stomach.

It is also alleged that he had tried to restrain the deceased’s relatives from taking her to hospital.

According to police records, the couple had an altercation before he whipped out a gun and allegedly shot his wife at close range.

Wanjiku, who was Odhiambo’s second wife, is alleged to have attended a party with friends that night.

The State Counsel told court that the medical report established that the accused was fit to stand trial.
