Constable Gilbert Ingosi Chemosi was condemned to face the hangman by Nairobi Chief Magistrate Hannah Ndung’u on Thursday.
Chemosi was convicted for violently robbing Chrispine Otieno Odongo of Sh90,000 on June 25, 2012 along Bandari Road in Nairobi’s Industrial Area, shortly after he withdrew the money from a bank.
Magistrate Ndung’u however acquitted his co-accused George Kamau Ndogo, a civilian, as there was no direct evidence linking him to the offence.
Ndogo is facing separate robbery with violence charges alongside three other police officers and the verdict is pending.
Chemosi had also been accused with refusing to have his fingerprints taken during investigations, but the court dismissed the charge for lack of evidence.
The court sent the police officer to the gallows after the complainant positively identified him. He was dressed in police uniform at the time.
“The complainant had a firm resolve and was sure that the police officer was involved in the robbery,” she ruled.
The court rejected Chemosi’s defence that on the fateful night he “never left his workstation” and held that he was in a position to leave the workstation, commit the crime and rush back.
