Omtatah in court to block appointment of police boss

According to the petitioner, sections of the amended Act take away both the security tenure, and independence of the two deputies Inspector General hence undermining the very independence of the National Police Service.

“The amended Act unconstitutionally takes away the security of tenure from the IG and his two deputies leaving the entire police service at the mercy and whims of the President’,” he said.

It is his argument that the amendments also block the reforms envisioned in the Agenda Four items of the National Accord and Reconciliation Agreement that ended the 2007/08 post-election violence.

He went on to say that President Kenyatta’s appointment of Samuel Arachi as acting IG contradicts the Constitution which exclusively vests the mandate to the Johnston Kavuludi led commission.

“ Under article 27 requires that the process of recruiting and appointing the inspector general be one in which all people are treated equally before the law because the direct nomination denied those who were interested in the job the opportunity to apply for it,’’ he stated.
