The two, through lawyer Evans Monari of Coulson Harney Advocates have threatened to institute legal action against the CORD legislators over the defamatory statements which they say have caused extensive damage to their reputation in the public eye.
“Take notice that should the admission, retraction and apology not be forthcoming from yourselves in the next seven days from today, we have firm instructions to institute a suit against yourselves, jointly and severally, for defamation at your risk as to the costs and attendant consequences,” read part of the letter from Monari.
Kimaiyo and Muhoro are demanding that the CORD lawmakers admit that the statement was defamatory, issue a retraction and publish an apology in one of the leading newspapers exonerating them.
Monari terms the allegations levelled against the two as baseless, unjustified and deliberately slanted to inflict the greatest possible harm adding that they not motivated by truth or concern for the public but by extreme malice and other ulterior motives, all calculated to injure them.
Senators James Orengo, Johnson Muthama, Boni Khalwale, Elizabeth Ongoro and Suna East MP Junet Mohammed had accused the State officers of being part of other purported beneficiaries of the 134-acres of the prime Karen land estimated to cost Sh8 billion.

The land is the subject of a court case filed by lawyer Cecil Miller on behalf of businessman Horatious Da Gama Rose.
Da Gama Rose claims that he is the rightful owner of the land having purchased it in 1982 through Barclays Bank and not Telesource as alleged.
The CORD legislators were expected to present the evidence to back their claims to the Ethics and Anti Corruption Commission (EACC) this week, but later said they would do so next Wednesday.
