NAIROBI, Kenya, Oct 13 – Three Cabinet Secretaries Charity Ngilu, Joseph Ole Lenku and Jacob Kaimenyi are set to appear before legislators to respond to their queries when the National Assembly resumes sitting on Tuesday.

Lands, Housing and Public Works CS Ngilu will kick off the inaugural General Oversight Committee sitting when she responds to Homa Bay Town MP Peter Kaluma’s request for a statement on measures the government is taking to safeguard custody of files and other documentation relating to land and ensure that all parcels of land which are ascertained to have been irregularly sub-divided and/or allocated are revoked and re-allocated to the rightful owners.

Ngilu will also seek to brief the House on the actual size of land which has been set aside for the development of Konza Techno-City and efforts the Ministry is making to resolve disputes.

Ngilu who was a cabinet minister in the former President Mwai Kibaki administration will relish the encounter with the MPs unlike her colleagues who have been accused by the Deputy Minority Leader of ‘acquiring larger than life personalities to the extent that they ignore House Committee summons and hide behind the reason that they are busy launching a government project’ may find themselves in a baptismal of fire.

Lenku will follow in shortly when he briefs the House on the number of livestock recovered by the police following the June 6 raid by cattle rustlers in Baringo County and the progress of investigations into the killing of about 17 persons during the raid. The statement has been requested by Baringo County Woman Representative Grace Kiptui.

Lastly, Kaimenyi will seek to assure MPs that the retirement of the 5,000 teachers last month will not derail free primary education programmes.

The CS will also be expected to brief the House on measures the government has taken on the culprits found guilty of taking part or abetting cheating in the national examination. He will then tackle another query where he is expected to show he has dealt with the school heads who still continue to withhold examination certificates belonging to former students who are unable to pay their school fees arrears.

This is despite a directive by Deputy President William Ruto and the Kenya National Examinations Council (KNEC) citing that KNEC Act which was amended in 2012 outlawed the withholding of certificates due to fees arrears.

The ministers appearance has received opposition from lawyers with the Commission for the Implementation of the Constitution (CIC) and Law Society of Kenya saying it goes against the spirit of separation of powers.

The CSs appearance is a departure from past practice, where committee chairmen answered questions from MPs on their behalf with the special committee meeting held every Tuesday but the MPs accused committee chairmen of lacking the competence to respond to technical issues on behalf of CSs while others argue that by making chairmen, who are MPs, to answer questions on behalf of CSs was violating the principle of separation of powers between Parliament and the Executive.
