NAIROBI, Kenya, Oct 3 – Motorists in Nairobi will have to pay Sh300 in parking fee after the Court of Appeal threw out a case challenging the new charges.

The fee was increased from Sh140 after the enactment of the Finance Act 2013 by the Nairobi County Assembly in September last year.

This increase was to affect both private motorists and Public Service Vehicles (PSVs) operating within Nairobi.

The appeals court ruled that the County Government is permitted to enact laws on traffic.

The petitioners had argued that in enacting the Act, and in its implementation, the County Government acted in contravention of the Constitution and the Traffic Act.

Other than the Nairobi Central Business District, the amount also applies for public parking in Westlands, Ngara, Industrial Area, Karen Shopping Centre, Nairobi West and Community areas.

The petitioners had further argued that the County Government exceeded its mandate, ” and violated the rights of the applicants, and that the continued implementation of that act would result in grave financial loss and prejudice to the applicants.”

Lawyer Harrison Kinyanjui who was representing the public within the county said: “The ruling was out of touch with the real situation.”

“Why should I pay Sh300 as parking fees for 10 minutes same as a person parking for the entire day?”

He said the fee was too high for city residents.
