High Court blocks Senate from summoning governors

“This committee expects any transaction of business between it and Embu to be led by the deputy governor. We are therefore directing that she (Nditi) appears before this committee on October 30, 2014,” ruled the Kakamega Senator.

The officers who were representing Wambora said they were directed by the governor and were only submitting to authority.

The Senate had impeached Wambora over allegations of abuse of office and gross violation of the constitution.

Wambora however went to court barring the Senate from dismissing him and also sought an order stopping the swearing in of Dorothy Nditi as the Embu County Governor. Article 179(5) of the Constitution, states that: When the county governor is absent the deputy governor shall act as the county governor.

“It is quite possible that the former governor of Embu Mr Wambora might have feared to ask his deputy governor to lead this group because he would then be confirming that it is she who is the governor. That drama will be played in Embu and not at the seat of the Senate,” Khalwale quipped.

Senators present at the sittings were Nyandarua Senator Murue Kariuki, Kisumu Senator Anyang Nyong’o, West Pokot Senator John Lonyangapuo, and Nyamira Senator Kennedy Mong’are.
