NAIROBI, Kenya, Aug 5 – The Independent Policing Oversight Authority (IPOA) on Tuesday moved to court seeking nullification of the just concluded tainted exercise of recruiting 10,000 new officers.

In the suit papers filed at the High Court in Nairobi before Justice Weldon Korir, IPOA Chairman Macharia Njeru cited massive irregularities to substantiate his reason calling for nullification of the recruitment.

“The exercise was marred by maleficent irregularities, was conducted in a manner that was not in compliance with the Constitution and hence led to the great hue and cry from members of the public and aggrieved participants,” he said.

He requested the court to treat the application as urgent as he argued the recruitment was ‘illegal, null and void.’

He argued that the exercise conducted by the National Police Service Commission did not meet the requirements of the Constitution and Section 10 of the National Police Service Act.

In the application IPOA further asked the court to issue an order that will compel the recruitment exercise to be repeated in view of complaints raised by members of the public. At the same time, IPOA asked the court to revoke police recruits selected on July 14.

“An order of certiorari does issue bringing to this court and quashing the outcome of the recruitment exercise carried out,” the application indicated.

It further requested the court to order an audit of money used for the recruitment exercise and where individuals are found guilty of misusing public funds, they should be held individually to account.

“An order do issue requiring the Kenya National Audit Office to carry out an audit of the funds used during the exercise and those found to have misused public funds to be held personally liable and be surcharged accordingly,” the application indicated.

IPOA also asked the court to compel the respondents to bear the costs of the petition.

The suit was filed a day after the National Police Service Commission chairman Johnstone Kavuludi received an interim report of a taskforce formed to probe the matter, but it does not recommend its nullification.

Ethics and Anti Corruption Commission Chairman Mumo Matemu has previously announced that the EACC will make a decision on the matter once the full report of the taskforce is released.

The team probing the recruitment was formed following complaints of massive irregularities which include corruption, nepotism among others.

After the police recruitment exercise on July 14 members of public cried foul with some of them complaining that the process was flawed.

They reported cases of corruption and nepotism by the recruiting officers in various parts of the country.

Leaders across the country have also complained over the manner in which the exercise was conducted and asked for its cancellation.
