Reverend John Mbugua who is a registered voter in Embakasi argues that the referendum push is a violation of his constitutional rights and should be halted.
The preacher wants the High Court to restrain CORD leaders Raila Odinga, Kalonzo Musyoka and Moses Wetangula from calling for the referendum.
He says the respondents should be directed to use Parliament to address the issues they want changed in the Constitution.
Reverend Mbugua also contends that if the CORD leaders lose the vote, they will not accept the outcome.
He claims the respondents have no moral authority to call for a referendum yet it will be conducted by the Independent Electoral and Boundaries Commission which they want disbanded.
Justice Isaac Lenaola has directed him to serve all the respondents and appear in court on October 8 for further directions.
