NAIROBI, Kenya, May 2 – Veteran Politician Kenneth Matiba has been allowed to amend a petition in which he is seeking over Sh9.1 million as damages for illegal detention by former President Daniel arap Moi’s regime.

High Court judge Isaac Lenaola gave Matiba’s lawyer the greenlight to modify his suit papers within seven days.

Attorney General Githu Muigai who has been named as the respondent was given 14 days to respond to the petition which was filed in March this year.

The case will be mentioned on July 2 for further directions.

The former Kiharu Member of Parliament wants the High Court to declare that he is entitled to compensation by way of damages for violation of his fundamental rights.

In his petition, Matiba claims that his administrative and leadership qualities and ability to participate in politics were greatly compromised and had to quit politics after the arrest.

As a result, Matiba says he continues to suffer excruciating psychological pain and mental anguish and his health has continued to deteriorate.

In the petition, Matiba avers that his arrest by the KANU government, detention and mistreatment were part of a large plot maliciously executed to perpetrate itself in power through undemocratic means.
