NAIROBI, Kenya May 22 – A CID officer was on Thursday charged for allegedly abducting Embu County Assembly Speaker Justus Kariuki Mate who has been missing since Monday.
Nicholas Muriuki Kangangi who is based at the Pangani Police Station’s CID department appeared before the Chief Magistrate’s Court at Milimani, Nairobi where he denied the charge of abduction with intent to unlawfully confine the Embu Speaker.
The prosecution applied that Kangangi be remanded at the Kilimani Police Station for two days as police continue with investigations.
The defence however opposed the prosecution’s application, saying that the accused had not interfered with the probe.
Magistrate Peter Ndwiga denied the prosecution’s application and ordered that the accused appear before the investigating officer at the Kilimani Police Station for further investigation.
The magistrate questioned why the officer was not arraigned in court within 24-hours after his arrest, saying his constitutional rights had been violated.
Kangangi was released on a Sh100,000 cash bail and ordered to appear in court on Monday next week for further orders before the case is heard on July 9.
Kangangi was allegedly scheduled to meet Mate on the day he disappeared from a Nairobi hotel.
Mate’s colleagues from the Assembly have claimed that he went missing after a telephone conversation with the CID officer.
On Wednesday, the High Court declined to grant orders sought by Mate’s wife to have the Inspector General of Police compelled to produce him after she failed to prove that police were in any way linked to the disappearance.
Presiding Judge Weldon Korir said Mate’s wife, Caroline Wangari, who wanted the police ordered to produce him had not provided sufficient information to warrant the court issue such orders.
Korir further directed Wangari to serve her application to the Director – Criminal Investigations Department, Starehe Divisional Criminal Investigation Officer (DCIO) and Inspector General of Police before Friday when the application is scheduled for hearing.
