Justice Jackton Ojwang and Smokin Wanjala said pending their ruling on March 26 ; the status quo should be maintained.
The Court said Independent Electoral Boundary Commission has raised a preliminary objection to the petition filed by the Governor who has sought to challenge the judgment of the Court of Appeal that nullified his March 4 2013 win.
Munya through his lawyers told the court that they raised a constitutional issue which the Supreme Court should make a determination on before any action is taken.
The ousted Governor moved to the Supreme Court on Thursday seeking an order to block the Independent Electoral and Boundaries Commission from declaring the Meru Governor’s seat vacant.
He wants the court to bar the execution of the judgment which declared that he was not validly elected during the last General Election.
The Court of Appeal nullified Munya’s election as Meru Governor on March 12.
