ICC witness contradicts her evidence

“If you used to listen to Kass FM, you would have known it broadcasts in English, Kiswahili… you said it only broadcasts in Kalenjin alone, you never used to listen to Kass FM,” Kigen charged to which the witness disagreed.

The witness also said she did not see Sang arrive at the Eldoret Showground in the presence of Ranneberger and Kigen concluded that the witness was not at the showground as she had said in her evidence-in-chief.

“The reason you didn’t see Mr Sang come with Ranneberger is because you were not at the showground, do you agree?” Kigen queried.

“No, I don’t agree,” the witness responded.

It was at that point that the witness, who has been posing questions to Kigen and avoiding some of his questions, again asked the lawyer a question which prompted the presiding judge’s intervention.

Kigen had put to the witness: “You were not at the showground that is why you didn’t see Sang”

Witness; “I don’t know what I will answer you because I have been told not to ask you questions. If I had a chance, I would have asked you. I have to be given time. I am not getting my rights respected, I am human… I need time.”

Judge Chile Eboe-Osuji reminded the witness to answer questions and also allow Kigen to perform his role as a lawyer.

“It is Kigen’s job to ask you questions. Do not argue with the lawyer and do not ask him questions back unless you are asking him to repeat his question because you did not understand the question. Listen to the question, no arguments and no asking questions back,” the judge advised.

Kigen further played many other clips of Sang urging for peace on Kass FM during the post election violence to which the witness said she had not heard his peace calls but only heard him incite violence over alleged election rigging.

The witness again contradicted her time frame in which she had said she listened to Kass FM after Kigen asked her if she listened to Sang on January 18.

“Did you listen to Kass FM on January 18th?” Kigen asked. “Yes,” the witness responded but when the lawyer repeated the question, she responded that she did not listen to Kass FM on January 18, 2008.
